Deconstructing Nusyuz through the Monologue Atas Nama Doa utawa Senyum Lastri: An Islamic Family Law Perspective

This study examines the monologue Atas Nama Doa utawa Senyum Lastri by Lintang Ismaya from the perspective of Islamic Family Law. It aims to explore how the play represents patriarchal domination, domestic violence, family disintegration, and socioeconomic injustice through the concepts of nusyuz, sakinah family, and the maqāṣid al-sharī‘ah principles of ḥifẓ al-nasl and ḥifẓ al-‘irḍ. Using a descriptive qualitative method with content analysis, the research analyzes the monologue alongside classical and contemporary fiqh, statutory regulations, the Compilation of Islamic Law, Constitutional Court decisions, and relevant scholarly literature. The findings indicate that patriarchal authority and victims’ silence reinforce structural injustice within the family; the absence of mawaddah and raḥmah demonstrates that legal marital validity alone cannot realize a sakinah family; and structural poverty, inheritance deprivation, and children’s exclusion reveal that economic justice is integral to Islamic family law. The study concludes that integrating literary sociology with Islamic Family Law provides an interdisciplinary framework that enriches contextual legal interpretation while promoting justice, human dignity, and legal literacy through performative literary.
